The sales contract is one of the most important documents in the life of an owner`s business. This is why it must be treated with care and rigour, with legal experts guiding both the seller and the buyer. 16 If there is a contract for the sale of goods by description, there is an implied condition for the products to comply with the description and, if the sale is made both in drawing and description form, it is not sufficient for most goods to match the sample if the goods do not fit the description. We therefore assert that goods can only be transferred/transported legally and legally through a registered transport obligation. If the seller does not sell or return the property to the buyer, the buyer is entitled to a special benefit in accordance with the provisions of the Specific Relief Act of 1963. A similar right is available to the seller as part of the agreement to require a certain benefit from the buyer.
60 (1) The common law provisions, including the merchant, also apply to the extent that they are inconsistent with the express provisions of this Act, including provisions relating to the law of the client and agent and the effects of fraud, misrepresentation, coercion, error or any other cause not valid for contracts for the sale of goods. (b) the validity of a sales contract under a particular common law or legal power to sell or on the orders of a competent court.
